1. Our Approach

1.1 GLOBAL ENTERPRISE CLOUD SYSTEMS ("GECS", "we"), trading as AdultSense, respects intellectual property rights and requires all users of the Platform to do the same. This policy explains how rights holders can notify us of alleged infringement in material hosted or served by GECS, how affected users may respond, and how we handle trademark complaints.

1.2 GECS operates an advertising marketplace and ad server. We host or serve advertising creatives, ad code and marketplace listings. We do not own, operate or host Publisher Websites, which are independent third-party websites. Complaints about content hosted on a Publisher Website should also be sent to the operator or host of that website. We will, however, forward valid notices concerning Publisher Websites on which we serve advertising and may suspend serving to websites that fail to act.

2. Legal Basis and Where to Send Notices

2.1 This policy is a voluntary notice-and-action procedure adopted by GECS under the laws of the Republic of Panama, where GECS is established. GECS is not established in the United States and this policy is not adopted under, and does not submit GECS to, the copyright law or courts of any other country. Rights holders anywhere in the world may use it.

2.2 Send notices to: GLOBAL ENTERPRISE CLOUD SYSTEMS, attention Copyright Agent, Show street address, Panama City, Republic of Panama, or by email to Show email. Use the subject line "IP notice" for notices and "IP counter-notice" for counter-notices. Correspondence on other topics sent to this address may not receive a response.

3. Infringement Notices

3.1 If you believe material hosted or served by GECS infringes your copyright or related rights, send a written notice containing all of the following: (a) your physical or electronic signature, as the rights holder or a person authorised to act on its behalf; (b) identification of the work claimed to be infringed or, if a single notice covers multiple works, a representative list of them, and the right relied on; (c) identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it, such as the exact URL, ad creative, landing page or marketplace listing; (d) your name, address and email address (and those of the rights holder if you act on its behalf); (e) a sufficiently substantiated explanation of why you consider the use unauthorised; and (f) a statement that you believe in good faith that the information in the notice is accurate and complete and that you are authorised to act for the rights holder.

3.2 Notices that do not substantially comply with these requirements may not be actioned. Where a notice identifies the work, the material and your contact details, we will try to contact you to obtain the missing elements.

3.3 We review valid notices in a timely, diligent, non-arbitrary and objective manner and will, where we consider it appropriate, remove or disable access to the material, notify the user who supplied it and provide that user with a copy of the notice (we may redact personal contact details).

3.4 Where the material appears on a Publisher Website rather than on our own systems, we will forward the notice to the Publisher, require it to address the claim and may stop serving advertising to the affected page or website.

3.5 Rights holders in the European Union may alternatively use the notice-and-action mechanism on the DSA Information page; we handle those notices under that page and give the affected user a statement of reasons and information on available redress, as described in the Abuse Reporting Policy.

4. Counter-Notices

4.1 If material you supplied was removed or disabled and you believe this was a mistake or misidentification, or that you are authorised to use it, you may send a counter-notice containing: (a) your physical or electronic signature; (b) identification of the material and where it appeared before removal; (c) an explanation of why you believe the removal was mistaken or the use is authorised; (d) your name, address and email address; and (e) a statement that you believe in good faith that the information is accurate and that you consent to your contact details being provided to the person who sent the original notice.

4.2 We will provide a copy of a valid counter-notice to the person who sent the original notice. If that person does not, within 10 business days, provide evidence that they have started legal proceedings or otherwise substantiate the claim to our reasonable satisfaction, we may restore the material. GECS decides on restoration in its sole discretion and is not required to restore any material.

4.3 Restoration of advertising material does not reinstate any Period already elapsed. Removal and restoration under this policy do not entitle any user to a refund; any credit is at GECS's sole discretion in accordance with the Advertiser Terms.

5. False or Abusive Notices

5.1 Anyone who knowingly submits a false or misleading notice or counter-notice is responsible for the consequences, including any loss or costs caused to GECS, the affected user or the rights holder. Before sending a notice, consider whether the use may be licensed or otherwise lawful. If in doubt, seek legal advice.

6. Courts and Legal Proceedings

6.1 Nothing in this policy is a submission by GECS to the jurisdiction of any court outside the Republic of Panama. Disputes between a complainant and a user are for them to resolve; GECS will act on a final order of a court of competent jurisdiction served on it in accordance with Panamanian law.

7. Trademark Complaints

7.1 If you believe an advertisement, landing page, ad code or marketplace listing uses your trademark in a way that is likely to cause confusion or otherwise infringes your rights, email Show email with the subject "Trademark complaint".

7.2 Please include: your name and contact details; the trademark concerned, the jurisdictions and registration numbers where applicable, and proof of ownership or authority; the exact location of the material; an explanation of why the use infringes your rights; and a good-faith statement that the information is accurate.

7.3 We will review the complaint, may ask the Advertiser or Publisher concerned to respond, and may remove, suspend or require modification of material. Use of a trademark for genuine comparison, description or other lawful purposes may not be removed.

8. Repeat Infringers

8.1 GECS will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers. As a guideline, an account that is the subject of three valid notices that are not successfully countered within any 12-month period may be terminated, although GECS may act sooner in serious cases, for example where infringement is deliberate or commercial in scale.

8.2 Termination for repeat infringement does not relieve the user of payment obligations already incurred, including winning auction bids.

9. Advertiser and Publisher Responsibilities

9.1 Advertisers warrant that they hold all rights required in creatives, trademarks, performers' images and landing page content (see the Advertiser Terms). Publishers warrant that their websites do not infringe third-party rights (see the Publisher Terms). Users must cooperate promptly with our investigation of any notice.

10. Misuse of the Process

10.1 Notices must not be used to harass, to suppress lawful competition or criticism, or to remove material the sender knows is lawful. After a warning, we may suspend processing of notices from senders who frequently submit manifestly unfounded notices.

10.2 Questions about this policy: Show email, subject "IP notice".
